Your company is subject to the inside information disclosure requirements under Regulation (EU) No. 1227/2011 (“REMIT”). Since 1 January 2021 companies registered as power or natural gas market participants are required to disclose their inside information exclusively via a formally accredited Inside Information Platform (IIP).
In its Guidance (5th Edition), the Agency for the Cooperation of Energy Regulators (“ACER”) stated that reporting via an own website does no longer comply with REMIT’s disclosure requirements. Furthermore, market participants without physical facilities or with generation units with a production capacity below 100 MW must also be able to report market-relevant information via an IIP.
National Regulatory Authorities (NRAs) such as BNetzA in Germany recently started to double check if registered market participants completed their registration in full by nominating an official IIP for inside information disclosure other than their own website.
